Terms of Business
1. ESTIMATES: Except where agreed with the client in advance of work starting and because of the nature of bus restoration, no fixed price restoration work is undertaken. We will endeavour to
work within estimates provided but the client is liable for all hours charged to the project, at the agreed hourly rate, plus the cost of materials used. An estimate is a reasonable guess of the
costs involved without knowledge of the exact extent of the work to be done or the exact costs of materials.
2. BUDGETS: We will keep the client briefed on hours spent on their project and materials used, relative to budget.
3. If the client has no additional funds to cover the cost of additional work identified then the default position is that work will cease once the budget agreed with the client is
reached.
4. BusWorks accepts no liability for non-completion of the originally specified work in circumstances where the actual cost exceeds the estimated cost or where additional work is identified to
complete the originally specified tasks to an acceptable standard.
5. INVOICING: Restoration projects will be invoiced for 50% of the agreed initial budget for the proposed work programme and payment will be required in advance of any work starting. The
remaining balance will either be payable upon completion of the project or, once the initial 50% of project spend has passed, we will invoice on a monthly basis until project completion or agree a
schedule of payments to fund the project in the case of projects likely to cost in excess of £10,000.
6. Work for commercial bus operators on account and other clients where agreed will be invoiced on a monthly basis within an agreed project budget.
7. All work invoiced is subject to VAT at the prevailing rate.
8. Where any discounts on our standard rate are offered, invoices not settled within the terms stated on the invoice are liable to have the discounted rate withdrawn and replaced by our standard
hourly rate for all labour. Interest on overdue payments will be charged at 2% over bank rate at our principal bank, Barclays plc.
9. We reserve the right to cease work if any invoice remains unpaid after 30 days. Any materials or purchases remain the property of the BusWorks until paid for in full.
10. STORAGE: BusWorks is able to store vehicles for short periods of time upon completion of agreed work. However, this may result in the vehicle being stored offsite at secure outside or
undercover premises. Unless agreed otherwise, storage will be charged at £40 per week. Any storage resulting from non-payment is charged at £40 per week.
11. COLLECTION & DELIVERY: The BusWorks is happy to arrange collection & delivery of vehicles, including towing and low-loaders where necessary. During transit vehicles will be
covered by our motor traders' policy for third party damage only and the BusWorks is not liable for any mechanical defects that arise during transit.
12. PROJECT MANAGEMENT: All BusWorks projects are led by a Manager of the company, who is responsible for the delivery of all aspects of the project to the client’s satisfaction. Except
where agreed, the Manager will be the client’s principal point of contact.
13. CLIENT LIASION: Throughout the project we will maintain regular contact with client to advise of progress, any potential delays and cost relative to budget. We will provide updates by e-mail
at least every four weeks.
14. COMPLAINTS: In the event of any complaint about the Company's services, the client should seek to resolve the issue with the nominated Manager. If this does not provide a satisfactory
remedy, a written complaint should be submitted within 14 days to the Managing Director at the address above.
15. Complaints will be acknowledged within 10 working days, and the Company will aim to resolve any complaint within 28 days of it being made.
16. PUBLICITY: Unless otherwise agreed, the BusWorks is free to publicise the projects it is commissioned to undertake.
17. LEGAL ISSUES: Our appointment is governed by and construed in all respects in accordance with English law. By commissioning the BusWorks, we assume that clients have a full
understanding of our standard trading terms.
